Milwaukee's Best Contractors (MilwBest) offers you the following terms, and conditions contained in this agreement (the "Terms and Conditions"). Your use of this Web site and/or the services provided by MilwBest constitutes your acceptance to all such terms and conditions. 1. DESCRIPTION OF SERVICES. At MilwBest we offer membership to an exclusive group of service providers and suppliers (members) At MilwBest we provide you (consumers) with a list of our members to fulfill your service needs. However, we do not guarantee that these members are capable or willing to complete your service needs. Even though we examine the credentials of our members, we make no guarantees or representations regarding the skills or representations of such members or the quality of work they perform or to any of the materials used. MilwBest explicitly does not endorse or recommend using the services or purchasing materials provided by members.  MilwBest explicitly does not guarantee or warrant the outcome or quality of the services performed or materials used. Members displayed on this website are not employees of MilwBest, nor has there been any agency relationship created between MilwBest and any particular member. Any rights under agreements entered into with members are governed by the terms of that particular agreement. All disputes, if any shall be addressed directly with that service provider or supplier. YOU HEREBY AGREE TO RELEASE MILWBEST (MEMBERS, AFFILIATES, EMPLOYEES AND AGENTS) AND ANY OTHER PERSON, FIRM, OR ENTITY INCLUDING OUR BUSINESS PARTNERS FROM ANY DAMAGES OR CLAIMS (INCLUDING CONSEQUENTIAL AND INCIDENTAL DAMAGES) OF EVERY KIND OR NATURE, SUSPECTED AND UNSUSPECTED, KNOWN AND UNKNOWN, DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES AND YOUR DEALINGS WITH ANY SERVICE PROFESSIONALS/SUPPLIERS CONTAINED WITHIN THIS WEBSITE.

2. USE OF MILWBEST SERVICES. You agree that your use of the MilwBest website is for your personal use and not for any commercial or advertising purposes. You agree that all of the content and information posted on the MilwBest Web site, including but not limited to member profiles and ratings & reviews, is the sole and exclusive property of MilwBest, and that you have no right to use in any manner said information other than for your personal use without the written permission of MilwBest. Any violation of the aforementioned could result in significant damages, and you agree that you are liable to MilwBest for any such damages, and will indemnify MilwBest in the event of a third party claim against MilwBest based on or arising from your violation of anything stated above.

3. LINKS TO THIRD PARTY SITES. The links in the MilwBest web site will let you leave MilwBest's web site. The linked sites are not under the control of MilwBest and MilwBest is not responsible for the contents or functionality of any linked site or any link contained in a linked site, or any changes or updates to such site. MilwBest is providing these links to you only as a convenience, and does not imply endorsement by MilwBest of that particular site in any way.

4. MILWBEST'S MEMBERSHIP PRESCREENING PROCEDURES. MilwBest uses the following criteria when a member applies for membership in our network:

Licensing - MilwBest confirms at the time a service provider or supplier applies for membership, that a prospective new member is licensed by the State, if applicable. We recommend you verify current member's licensing status with state and local licensing authorities prior to entering into an agreement with any member in our network. We always recommend that you ask that they provide you with a copy of their license.

Insurance - When applicable, MilwBest confirms general liability insurance coverage or bonding information (for movers, either cargo valuation coverage or general liability insurance coverage) presented by prospective members at the time they apply for membership with MilwBest. MilwBest confirms such coverage with the member's insurance agent. MilwBest does not verify general liability coverage for certain categories of members where such coverage is deemed not relevant.

Business Status - We confirm that all members are in good standing in the state in which it is located. This check only applies to members that are corporations and Limited Liability Companies (LLC's).

Criminal Records Search - MilwBest uses 3rd party data sources to conduct a criminal search for any relevant criminal activity associated with the owner/principal of the business of any member.

Sex Offender Search - MilwBest uses 3rd party data sources to check the official Sex Offender web site in the State the owner/principal conducts business in, to confirm that there is not a match based solely on the name of the owner/principal of the company.  We recommend that you check the applicable state sex offender website for any individual that will be performing work in your home.

Social Security Number verification - MilwBest verifies the social security number(s) for identity check purposes. This check applies primarily to smaller business entities.

Reverse Search of Phone Records - We conduct a reverse business phone lookup to verify the phone number information provided by members.

Legal Search - We use 3rd party data sources that record legal information to check the principal / owner of the business for significant state-level civil legal judgments entered against the principal / owner by business customers within the 2-5 years prior to member's application with MilwBest, and check for bankruptcy filings by or against the principal / owner.

* Members information confirmed at the time of applying as a member may change or expire over time; while MilwBest attempts to maintain accurate and up-to-date information, and confirms changes when notified, we perform screening solely at the time the member applies for membership in MilwBest network, and therefore, we cannot guarantee that profile and screening information is accurate. Therefore, we recommend that before working with a service professional you verify that information is still current and/or acceptable to you.

Some Service Professionals are employees, franchisees, dealers, or independent contractors ("Corporate SP's") of larger national or corporate accounts ("Corporate Accounts"). In such event, you may be matched with the Corporate Account entity or with one of their Corporate SP's. The above screening criteria is not applicable to Corporate Accounts, and therefore, MilwBest does not screen the Corporate Accounts or Corporate SP's, but rather relies on the screening performed by the Corporate Account.

DISCLAIMER: MILWBEST EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED RELATING TO THE PRESCREENING PROCESS, CRITERIA, PROCEDURES, OR INFORMATION OBTAINED OR PRESENTED IN THE PRESCREENING PROCESS OR DISCLOSURES INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE, OR THAT THE SCREENING OR VERIFICATION PROCEDURES OR STANDARDS ARE SUFFICIENT OR THAT THE INFORMATION RECEIVED IN THESE SCREENING OR VERIFICATION PROCEDURES IS ACCURATE, TIMELY OR ERROR FREE.

5. RATINGS & REVIEWS ON MILWBEST.COM
From time to time MilwBest may at its discretion display ratings and reviews of its members on our web site at www.milwbest.com. MilwBest reserves the right, but not the obligation, to refuse to post or to remove any Review if MilwBest determines (in its sole discretion) that it contains or features any of the following:

1. Offensive, harmful and/or abusive language, including without limitation: expletives, profanities, obscenities, harassment, vulgarities, sexually explicit language and hate speech (e.g., racist/discriminatory speech.)
2. Any reference to illegal activity.
3. Reviews that offer no qualitative value.
4. Comments concerning a non member service provider.
5. Statements that are or appear to be false.
6. Comments that disparage MilwBest.

All Ratings and Reviews of any member of our network reflect the opinions of other consumers, and do not reflect or represent the opinions or representations of MilwBest. Reviews do not reflect the views of MilwBest; its parent, subsidiary or affiliated companies; or any of its members.
